Non-Disclosure & Confidentiality Agreement

Clause 1 - Proprietary Methodology

The SwingForm Genesis coaching methodology, including the StrikePlane system, session frameworks, biomechanical principles, drills, assessment tools, scoring models, and all related instructional content (collectively, "the Methodology"), constitutes proprietary intellectual property owned exclusively by SwingForm Genesis. Participants acknowledge that the Methodology is protected under applicable intellectual property law.

Clause 2 - Confidentiality Obligation

Participants agree to keep all aspects of the Methodology strictly confidential. You may not disclose, share, reproduce, publish, teach, or otherwise distribute any element of the Methodology to any third party - whether verbally, in writing, digitally, or through demonstration - without prior written consent from SwingForm Genesis.

Clause 3 - Session Materials

All session notes, handouts, frameworks, video recordings, drill sheets, and digital materials provided during the programme remain the intellectual property of SwingForm Genesis. These materials are licensed to you for personal use only and may not be copied, forwarded, uploaded, or shared on any platform without explicit written permission.

Clause 4 - No Coaching or Instruction of Others

Participants may not use knowledge, frameworks, or techniques acquired through SwingForm Genesis to coach, instruct, or teach other golfers - formally or informally - without completing an authorised SwingForm Genesis Coach Certification. Any such activity constitutes misappropriation of intellectual property and may result in legal action.

Clause 5 - Data & Scorecard Accuracy

Participants consent to the collection, storage, and analysis of their golf performance data, including scorecard results, accuracy metrics, and session progression data. You certify that all scorecard submissions will be accurate, honest, and unaltered. Falsification of data is grounds for immediate dismissal from the programme without refund.

Clause 6 - Media & Testimonials

SwingForm Genesis may capture photographs and video footage during programme sessions for training, documentation, and marketing purposes. Only if you separately opt in, you grant SwingForm Genesis a non-exclusive, royalty-free licence to use your likeness, name, and results (with your prior approval on specific content) in promotional materials. You may withdraw this consent in writing at any time.

Clause 7 - Duration of Obligation

Your confidentiality obligations survive the completion, discontinuation, or termination of your participation in any SwingForm Genesis programme and remain in effect indefinitely thereafter.

Clause 8 - Governing Law

This agreement shall be governed by the laws of the Republic of South Africa. Any dispute arising from or related to this agreement shall be subject to the exclusive jurisdiction of the courts of South Africa.

Attendance and disciplineI agree to attend all required sessions and complete prescribed drills in sequence. I will communicate promptly if I cannot attend.Completion deadlineI agree to complete the full course within its assigned programme time, which will not exceed 42 calendar days (six weeks) from my confirmed start date. My written enrolment confirmation will state the start date, deadline and completion requirements before payment.Completion-dependent proficiency guaranteeI understand that the voluntary proficiency money-back guarantee is valid only for courses completed in full within the maximum assigned programme time, including all required lessons, drills, assessments and evidence submissions. Partial completion, abandonment or late completion does not qualify under this voluntary guarantee. Completing the course means completing the required work, not already passing the proficiency standard. The applicable proficiency threshold and claim procedure must be provided before payment.Accurate, signed and marked scorecardsI agree to keep and record accurate scorecards for every required assessment, have them marked and signed by my nominated marker and sign them myself, or score and sign them myself if I have nominated Self Marking, and submit them with the required supporting records by the published deadlines. I will not estimate, fabricate, omit or alter results.Evidence and accountabilityI agree to keep an honest training log and submit required scorecards, drill records and assessment evidence on time. Evidence requirements and submission deadlines must be supplied before training begins.Focus and adherenceI agree to follow the prescribed Genesis methodology and training sequence without substituting or blending other swing methods during the course. I will seek clarification when unsure and apply the feedback provided.Respectful conductI agree to treat staff and other participants respectfully and follow reasonable training and venue instructions. Any concerns about conduct will be addressed under the programme terms supplied before enrolment.Report interruptions promptlyI agree to report illness, injury, technical problems or other interruptions promptly. Any permitted change to the assigned timetable must be confirmed in writing; an extension is not automatic.Terms and consumer rightsI understand the difference between the voluntary proficiency guarantee and cancellation or other refund rights. Applicable cancellation terms and the full guarantee terms will be provided before payment. Nothing in these acknowledgements excludes rights that cannot lawfully be excluded.Application and paymentI understand that submitting an application or selecting a course is not approval or enrolment. I will not make payment until my application is approved in writing. Each group participant must personally accept the applicable commitments.Application dataI consent to my application and performance records being used to assess my suitability, administer my training and verify results.
